FAR 52.219-2 and Tied Bids — What Happens When Two Contractors Bid the Exact Same Price

It sounds impossible. Two contractors, pricing a whole job, landing on the exact same number. But it happens, and it happens enough that the government wrote a rule for it two hundred years ago.

The rule lives in the FAR — the Federal Acquisition Regulation — specifically provision 52.219-2. It applies when a contract is awarded by sealed bidding and two bidders come in tied as equal low bids. Here's the part most people don't realize: the government has been buying goods and services since the country started, and every problem they've ever hit, they solved by writing a law or a provision and tucking it into the solicitation. That giant block of text you skip? It's two hundred years of accumulated problems, each one turned into a rule.

The tied-bid rule is a perfect example. Two guys land on the same number. What now? The provision says the government looks at who gets the award, and when they do, one of the big deciding factors is past performance and responsibility — in plain English, who they've actually seen do this work well before. The clause about equal bids exists because ties happen. The clause about changes exists because jobs change.
